These Terms and Conditions form a client agreement between you (the client, referred to as you or your) and Gentle Embrace Lactation Services – Nicole Leccese ABN: 25721301389 (referred to as we, us, or the Lactation Consultant).
These Terms and Conditions also incorporate the Fee Schedule, which is available separately and should be read in conjunction with this agreement.
By making a booking with Gentle Embrace Lactation Services – Nicole Leccese, you acknowledge that you have read, understood, and agree to these Terms and Conditions and the associated Fee Schedule.

Description of services
These Terms and Conditions apply to the services provided by Gentle Embrace Lactation Services – Nicole Leccese. Services include antenatal and postnatal breastfeeding and lactation support and management, delivered through in-person consultations, telehealth appointments, courses, education programs, and written or video resources.

Bookings
All clients with a booking will receive an appointment reminder approximately 24 - 48 hours before their scheduled appointment. We kindly ask that you confirm your appointment by replying via text message or email. Appointments booked within 24 hours of the scheduled time are automatically confirmed.

If confirmation has not been received, Gentle Embrace Lactation Services – Nicole Leccese will make reasonable efforts to contact you to confirm your appointment and to collect any required pre-appointment information.

By making a booking, you acknowledge and accept the cancellation and no-show policy and the applicable Fee Schedule as detailed in these Terms and Conditions.

Payments
A non-refundable deposit is required to secure an appointment at the time of booking.

For online (telehealth) appointments, a deposit of $20 is required for all session durations (20, 40, and 60 minutes).

For in-person appointments, a deposit of $50 is required.

The remaining balance must be paid on the day the services are provided.
Where payment is not made in accordance with these Terms and Conditions, the provider reserves the right to modify, suspend, or cancel services. Any outstanding amounts may be pursued in accordance with application Australian law.

Payments can be made via bank transfer or in cash at the time of appointment.

A No Show occurs when Gentle Embrace Lactation Services – Nicole Leccese, or a nominated representative, attends the scheduled appointment location at the agreed appointment time and the client is not present within 15 minutes of the appointment commencement (including online appointments)

In the event of a No Show, reasonable efforts will be made to contact you to discuss the appointment and, where possible, offer an opportunity to reschedule.

The non-refundable deposit will be forfeited & any extras fees associated with travel will be invoiced & payable on the same day.
Gentle Embrace Lactation Services – Nicole Leccese reserves the right to waive the no-show fee in circumstances where the failure to attend was due to exceptional or unforeseen circumstances, assessed on a case-by-case basis.

Gentle Embrace Lactation Services – Nicole Leccese is committed to providing high-quality care and ensuring client satisfaction. If you are unhappy with any aspect of the services provided, we encourage you to contact us directly so your concerns can be discussed and, where appropriate, addressed. As an International Board Certified Lactation Consultant (IBCLC) & registered midwife, Nicole adheres to the IBCLC Code of Professional Conduct. Liability & Indemnification
To the fullest extent permitted by law, Gentle Embrace Lactation Services – Nicole Leccese IBCLC RM excludes all liability for any loss, damage, injury, claim, cost, or expense arising out of or in connection with the provision of, use of, or reliance on any services, products, or information supplied. This includes, without limitation, any direct, indirect, incidental, special, or consequential loss, including loss of profits, revenue, savings, data, or replacement costs. This exclusion of liability applies irrespective of the cause of action or legal basis of the claim, including contract, tort (including negligence), statute, strict liability, or otherwise, and extends to any loss or damage arising from errors or omissions in information provided, or from the use of any service, content, or product supplied or made available. Nothing in these Terms and Conditions operates to exclude, restrict, or modify any consumer guarantees, rights, or remedies available under Australian Consumer Law or any other applicable legislation which cannot lawfully be excluded.

You agree to indemnify and hold harmless Gentle Embrace Lactation Services – Nicole Leccese IBCLC RM from and against any claim, demand, loss, damage, liability, cost, or expense (including reasonable legal costs) arising out of or in connection with:
your breach of these Terms and Conditions or any documents incorporated by reference; or your violation of any applicable law or the rights of any third party.
